VODACOM does it again.
I just cannot
believe these people can get away with this – my upgrade date is 2009-10-30
which makes me think my contract ends around December – so for 7 months with
the same spend (R135 on both old and new packages) on a contract they want me
to pay R 1454 (Cell phone subsidy fee) – How do they work this out - if you
look at the note section which says “A

ADDENDUM: Top Up Migrations
TERMS and CONDITIONS
DEFINITIONS
1.1 "the Customer" shall mean the person or entity who entered into an
Agreement with VSP
1.2 "Pre-Paid account" shall mean an account held by Vodacom on behalf of
the Customer which, when credited with a pre-determined value of
airtime purchased by the Customer, enables the Customer to utilize
the Services until such airtime is depleted;
1.3 "Subscription Fee" shall mean the monthly fee payable by the Customer
in consideration for access to the Network by means of the Customer
Number;
1.4 "VSP" shall mean Vodacom Service Provider Company (Pty) Ltd with whom
the Customer has entered into an Agreement;

1. On the first day of each month, Vodacom shall automatically recharge
the Customer's Pre-Paid account with airtime to the value of the
Subscription Fee provided that such airtime shall not be available for
use by the Customer if he is in arrears with the payment of his
Subscription Fees.
2. In addition to the airtime value allocated to the Customer's Pre-Paid
account as per clause 1 above, the Customer shall also be entitled to
recharge his Pre-Paid account at any time by utilizing any of
Vodacom's existing recharge mechanisms provided that the Customer
is not in default with the payment of his Subscription Fee(s).
Such recharge shall:
2.1 not be available for use by the Customer until he has paid all
outstanding Subscription Fees
2.2 not be set-off against any outstanding Subscription Fees
3. In the event that the Customer pays VSP more than what is due in
respect of the Subscription Fees, such additional amounts paid shall
not be allocated to the Customer's Pre-Paid account but shall either:
3.1 be set-off against the following month's Subscription Fees; or
3.2 be refunded, free of interest to the Customer, if at the end of
term of the Agreement his Subscription Fees are fully paid up
and all his obligations have been fully discharged.
4. Unused airtime value from the previous month may be carried over to
the following month in such portion as may be published by Vodacom in
its Tariff brochure (or otherwise), from time to time.
5. Any accumulated airtime existing at the termination and/or
cancellation of the Agreement shall be forfeited and the Customer
shall have no claim of whatsoever nature against VSP in respect
thereof.
6. In the event that the Customer migrates from a tariff plan which

includes free bundled minutes, all unused bundled minutes will be
forfeited and the Customer shall have no claim of whatsoever nature
against VSP in respect thereof.
7. The Customer shall not be entitled to convert to standard pre-paid.
8. Should the Customer default in any of his/her payment obligations,
then VSP shall be entitled to prevent the further use of the
Customer's Cellular's Phone and the Customer indemnifies VSP in
respect of any claim whatsoever arising from VSP exercising its right
in terms hereof.
9. VSP reserves the right, in its sole discretion, to vary the terms and
conditions of the Agreement. VSP may elect, in its sole discretion, to
notify the Customer of such variation in writing or to publish such
variation at its principal place of business, or on
www.vodacomsp.co.za.
10. The Customer shall only be entitled to such Services then available to
Vodacom's pre-paid customers as may be relevant from time to time,
provided that:
10.1 the Free Change Service; and
10.2 the Incomer vouchers will not be available to the Customer; and
10.3 the Activity Rule; and
10.4 airtime window;
will not be applicable to the Customer, unless and until the
Customer is notified otherwise pursuant to the provisions of
clause 9 above.
11. All words and expressions not defined herein shall have the meanings
assigned to them in the Network Service Agreement. In addition to the
and conditions of this addendum all the terms of the existing airtime
contract shall continue to be of full force and effect. In the event
of any contradiction between these terms and conditions and the terms
of the existing airtime contract, these terms and conditions shall
take precedence.
